Mediation Services in Kenya

If you talk to a man in a language he understands, that goes to his head. If you talk to him in his language, that goes to his heart.

Nelson Mandela

  • If you were to audit your life, how many unresolved issues did you put in the ‘packing load’?
  • When idolizing in your mind, what do you wish to do with those aggrieved parties and the unresolved issues in any sector of life?
  • What is your fear of facing the other party and getting the difference mediated?
  • Conflict is an integral part of life; these fellow human beings are not your siblings, and even in the home, their sibling rivalry is real.
  • Saul Alinsky said, “Change means movement. Movement means friction. Only in the frictionless vacuum of a non-existent abstract world can movement or change occur without that abrasive friction of conflict.”

Mediation is a structured process where a neutral third party (the mediator) helps people in conflict talk through their issues, understand each other’s perspectives, and work together to reach a mutually acceptable agreement. The mediator doesn’t take sides or make decisions for them. The goal is to facilitate communication and help parties find a solution they can both agree on.

This is the process of addressing disagreements or disputes constructively to enable the parties involved to reach an understanding, restore peace, and maintain healthy relationships. It is about finding peaceful solutions to problems between people or groups.

This is the process where parties in conflict (often groups, communities, or nations) come together to discuss their differences and reach an agreement that ends violence or tension, and builds lasting peace. It is talks aimed at finding peaceful. solutions instead of fighting

  • Mediation is one method of conflict resolution that focuses on guided dialogue by a mediator. Mediation is a specific conflict resolution method, where a neutral third party helps the aggrieved persons to reach an agreement.
  • Conflict resolution is the big picture, where all the strategies are used to handle and resolve disputes. It is the broader process of addressing and managing disputes in different ways and at different levels.
  • Peace resolution focuses on ending large-scale violence or war.

Some mediations focus on finding solutions, others on improving relationships, and some are specialized for settings like family, workplace, or community. The following are types of mediations.

  • Facilitative Mediation - The mediator guides the process and helps parties communicate, but does not suggest solutions.
  • Evaluative Mediation - The mediator gives opinions, points out strengths/weaknesses, and may suggest possible outcomes.
  • Transformative Mediation - Focuses on improving relationships, empowerment, and mutual understanding rather than just solving the issue.
  • Court-Ordered Mediation - Ordered by a judge to help parties resolve disputes outside the courtroom.
  • Community Mediation - Used for resolving conflicts within neighbourhoods, families, or local communities.
  • Workplace Mediation- Helps employees or employers resolve disputes in professional settings.
  • Family Mediation - Focused on family issues like separation, parenting, or inheritance disputes.

Mediation helps people resolve disputes peacefully, improves communication, reduces stress and hostility, saves time and money compared to court battles, preserves relationships, and allows parties to create fair solutions they both agree on. It promotes peaceful, fair, and lasting solutions while protecting relationships.

This mediator acts as a neutral guide who helps people in conflict communicate better, understand each other’s perspectives, and work toward a fair agreement without taking sides or making decisions for them. A mediator facilitates dialogue, ensures fairness, and supports parties to reach their own solution.

A mediator can come from different professional backgrounds depending on the type of disputes they handle. Mediators come from Law, Counselling, Human Resource, Social Work, or Peace Studies backgrounds, but they should be specially trained in conflict resolution skills. Common ones include:

  • Counselling / Psychology - Therapists or counsellors who mediate family, workplace, or interpersonal conflicts.
  • Law - Lawyers or judges trained in mediation for legal disputes.
  • Social Work / Community Development - Professionals skilled in resolving community or social disputes.
  • Human Resources / Management - For workplace and organizational mediation.
  • International Relations / Peace Studies - For political or cross-border peace mediation.
